Terms of service

This agreement

These terms are between you and Apical Dynamics Limited, a company incorporated in Zambia. They apply when you use this website, Agrinora, Agrinora Livestock or diagnosticaMD. If you are agreeing on behalf of a farm, a clinic or a company, you are confirming you have authority to do that.

If you do not accept these terms, do not use the software. That is the only consequence.

What the products are

• Agrinora is farm management software: fields, tasks, work plans, enterprises, budgets and records of what was spent and earned.
• Agrinora Livestock is individual animal record software: identity, parentage, weights, treatments and calving records.
• diagnosticaMD is clinical decision support: it takes clinical features and returns a weighted differential.

What diagnosticaMD is not

diagnosticaMD does not diagnose patients. It offers a differential to think against. The clinician using it holds the clinical responsibility for the patient, exactly as they would without it. Do not use it as the sole basis for a diagnosis, a prescription, or a decision to discharge.

It is intended for use by qualified health workers. It is not medical advice to the public, and it is not a substitute for examining a patient.

The tool reflects what is circulating locally and what the clinical features suggest. It can be wrong, and it can be wrong while sounding certain. Treat it the way you would treat a colleague giving you an opinion in the corridor.

Your account and the people on it

• Keep your password to yourself. Anything done through your account is treated as done by you.
• Give us an email address that reaches you, because that is how we reach you about your account.
• If you invite people to your farm, you are responsible for who you invite and for what they can see. The roles exist for a reason and the defaults are deliberate.
• Tell the people you invite that their names and their work are recorded in a system. That conversation is yours to have, not ours.
• If you think someone has got into your account, tell us straight away.

What you may not do

• Use the software to break Zambian law.
• Upload someone else’s personal information that you have no right to hold.
• Try to reach another farm’s data, or probe the system for a way to.
• Resell the software, or run it as a service for others, without our written agreement.
• Deliberately overload the system, or scrape it.
• Remove or obscure our name from the software.

Security research is welcome. If you find a way in, tell us at yourtech@apicaldynamics.com before you tell anyone else, and give us a reasonable chance to fix it. We will not come after anyone who does that in good faith.

Who owns what

Your records are yours. Every field, task, expense, animal and photograph you put in belongs to you, and nothing in these terms transfers that to us. We hold it so the software can show it back to you, and we will not use it to train anything, sell it, or share it, beyond what the privacy policy describes.

The software is ours. The code, the design, the name Apical Dynamics, the name Agrinora and the name diagnosticaMD remain our property. You get permission to use the software, not ownership of it.

You can export your finance records to PDF or Excel from within Agrinora. If you want everything, ask us and we will get you a full copy.

Availability

We do not promise the software will always be up. We run it carefully and we have no interest in it going down, but we are not offering a service level agreement and you should not plan as though we were.

We may change features, and occasionally remove one. If we are going to remove something you depend on, we will tell account holders before we do it.

Keep your own copy of anything you could not stand to lose.

Price

The products are free to use today. We may introduce paid plans. If we do, existing accounts will be told in advance, nothing you have already put in will be held hostage behind a paywall, and you will be able to export your records whether or not you decide to pay.

Liability

The software is provided as it is. To the extent Zambian law allows, we are not liable for lost profit, lost yield, lost livestock, lost opportunity, or decisions taken on the strength of what the software showed you.

Where liability cannot be excluded, it is limited to the greater of the amount you have paid us in the preceding twelve months, or five hundred Zambian kwacha.

Nothing here limits liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited.

Ending it

You can stop using the software whenever you like, and you can ask us to delete your account. See the data deletion page.

We can suspend or close an account that is breaking these terms, or being used to harm someone. Unless the situation is serious or urgent, we will warn you first and give you a chance to put it right.

Law

These terms are governed by the laws of Zambia, and the courts of Zambia have jurisdiction. If part of these terms turns out to be unenforceable, the rest still stands.

Changes

We will change the date at the top when we update these terms. If a change matters, account holders will be emailed before it takes effect.
